This is an appeal from the denial of relief under Alaska Rule of Criminal Procedure 35(a). Robert Bishop was convicted of driving while intoxicated. AMC 9.28.020(A). The trial court found that Bishop had a particularly bad driving record and sentenced him to 360 days incarceration. Bishop did not appeal his sentence. Anchorage does not maintain a prison for those convicted of municipal offenses. It contracts with the state of Alaska to lodge and supervise its convicts. See Dwyer v. State, 449 P.2d 282 (Alaska 1969) (discussing legality of one government contracting with another to house the formers prisoners). Bishop will therefore serve his term in a state facility.
